MORNING STAR MEDIA TEAM
Service Agreement & Terms of Service.
By booking photography or videography services with Morning Star Media Team, the client agrees to the following terms and conditions.
Booking Confirmation
A session or project is considered confirmed once the client completes the booking process and any required deposit or payment is received. Morning Star Media Team reserves the right to decline or reschedule services when necessary.
Payment
Payment terms may vary depending on the type of service. In most cases payment is due before or on the day of the session unless otherwise agreed. Deposits or booking fees, if required, secure the scheduled date and time.
Cancellation Policy
Deposits or booking fees are nonrefundable. Clients may reschedule their session with at least 24 hour notice. If a cancellation occurs with less than 24 hours, Morning Star Media Team reserves the right to retain the booking fee.
Rescheduling
Sessions may be rescheduled due to weather, emergencies, or circumstances outside the control of Morning Star Media Team. In the case of outdoor sessions, weather conditions may require rescheduling to ensure quality results.
Client Responsibility
Clients are responsible for ensuring that locations, venues, or properties are ready and accessible at the scheduled time. This includes cleanliness, staging, lighting conditions, and any required permissions to photograph or film at the location.
Real Estate & Property Readiness
For real estate photography, the property should be fully prepared before the scheduled appointment. Morning Star Media Team is not responsible for cleaning staging or moving items. With the property owner’s or agent’s permission, the photographer may move small or lightweight items (such as chairs, decor, trash bins, or small objects) to improve the composition of a photo or video. However, Morning Star Media Team will not move large furniture, heavy objects, or items that may risk damage to the property or injury.
Drone Operations
Drone photography or videography is subject to weather conditions, location restrictions, and FAA regulations. Certain locations may restrict drone operations. If drone services cannot be completed due to legal restrictions, safety concerns, or weather conditions, the drone portion may be rescheduled or adjusted.
Creative Control
Morning Star Media Team maintains full creative control over the artistic style, editing, composition, and final selection of delivered images or videos. The final deliverables represent the professional judgement of the photographer or videographer. Once the final photos or videos have been delivered to the client, agent, or customer, they may use the media for their personal or business purposes with their consent, including marketing, listings, social media, and promotional use, unless otherwise specified in writing. However, the images or videos may not be sold, transferred, or licensed to third parties without written permission from Morning Star Media Team.
Delivery Timeline
Media delivery timeliness vary depending on the service provided. Typical turnaround time is within a few days unless otherwise stated. Delivery may occur depending on workload, project size, or editing requirements.
Image Usage Rights
Clients receive use rights for personal or business purposes depending on the service booked. Images and media may not be sold, licensed, or redistributed to third parties without written permission from Morning Star Media Team.
Marketing & Portfolio Use
Morning Star Media Team reserves the right to use photos or videos captured during sessions for marketing, advertising, website display, portfolio use, and social media unless otherwise requested by the client.
Liability
Morning Star Media Team will take every reasonable step to ensure high quality service and secure handling of media files. However, the company shall not be held liable for circumstances beyond control including weather conditions, location restrictions, accidents, or other unforeseen events. In this unlikely event that photos or videos cannot be delivered, liability is limited to the return of any payments made for the affected service. Morning Star Media Team will make reusable effort to resolve the situation, including rescheduling services when possible.
Travel & Access
Morning Star Media Team reserves the right to decline or refuse bookings that are located outside of the standard service area or are determined to be an extended travel distance. In some cases, travel arrangements may be discussed and approved in advance at the discretion of Morning Star Media Team. Wherefore, clients are responsible for providing accurate location details for the scheduled session.
Event & Session Coverage
While every effort will be made to capture key moments, specific images, poses, or individuals cannot be guaranteed unless previously discussed and agreed upon before the session or event. Clients are encourages to communicate any important people, moments, or details they would like prioritized.
Agreement
By booking services with Morning Star Media Team, the client confirms that they have read, understood, and agreed to the terms outlined in this agreement.
